Concept
Data Protection Board of India
The enforcement body established under section 18, which is in force. Most of its core work is not in force yet. Receiving breach intimations and complaints and inquiring under section 27 commence on 13 May 2027, as does section 28 on the Board's procedure, although Rule 20, in force since 13 November 2025, already provides that the Board shall function as a digital office. From 13 May 2027, individuals can approach it only after exhausting the organisation's grievance channel under section 13(3). One exception is section 27(1)(d), inquiry into breaches of a Consent Manager's registration conditions, which commences on 13 November 2026. The 13 May 2027 and 13 November 2026 dates are computed from the notification, so treat them as interpretation until officially confirmed.
“Board” means the Data Protection Board of India established by the Central Government under section 18

What the definition covers
Plain English
Section 2(c) defines the Board as the Data Protection Board of India established by the Central Government under section 18. Section 18(1) establishes it with effect from such date as the Central Government may, by notification, appoint, and G.S.R. 844(E) of 13 November 2025 established it with effect from the date of publication of that notification, with its head office in the National Capital Region of India. Under section 18(2) it is a body corporate with perpetual succession and a common seal, with power, subject to the provisions of the Act, to acquire, hold and dispose of property and to contract, and it sues and is sued in its own name. Section 2 and sections 18 to 26, which establish and constitute the Board, have been in force since 13 November 2025 under paragraph (a) of the commencement notification. Establishing the Board is a separate step from appointing its Chairperson and Members, which section 19(2) leaves to the Central Government in the manner prescribed by Rule 17.
Plain English
Section 19(1) provides for a Chairperson and such number of other Members as the Central Government may notify, and G.S.R. 845(E) of 13 November 2025 notifies that the Board “shall consist of four members”. Each must be a person of ability, integrity and standing with special knowledge or practical experience in a field section 19(3) lists, or in any other field the Central Government considers useful to the Board, and at least 1 among them shall be an expert in the field of law. They hold office for 2 years and are eligible for reappointment (section 20(2)), shall not be removed by the Central Government unless given an opportunity of being heard (section 21(2)), and for 1 year after ceasing to hold office may not accept any employment except with the previous approval of the Central Government (section 22(3)). Rule 17 sets 2 search and selection committees, chaired by the Cabinet Secretary to recommend individuals for appointment as Chairperson and by the Secretary of the Ministry of Electronics and Information Technology for the other Members, and the Central Government appoints after considering the suitability of those recommended; Rule 18 applies the Fifth Schedule to their salary, allowances and terms of service. Sections 19 to 22 have been in force since 13 November 2025, and Rules 17 to 21 since the same date under Rule 1(2).
Plain English
Section 27(1) gives the Board 5 functions, each to inquire into a breach and impose penalty as provided in the Act: on receipt of an intimation of a personal data breach under section 8(6), where it may also direct urgent remedial or mitigation measures; on a complaint by a Data Principal about a personal data breach, or about a Data Fiduciary's breach of its obligations in relation to her personal data or the exercise of her rights under the Act, or on a reference by the Central Government or a State Government, or in compliance of the directions of any court; on a complaint by a Data Principal about a Consent Manager's breach of its obligations in relation to her personal data; on receipt of an intimation of breach of any condition of registration of a Consent Manager; and on a reference by the Central Government about an intermediary's breach of section 37(2). Section 27(2) lets it, for the effective discharge of its functions under the Act, issue such directions as it considers necessary, binding on the person concerned, after giving that person an opportunity of being heard and recording reasons in writing. Section 27(1)(d) commences on 13 November 2026, and the rest of section 27, with sections 8(6) and 37(2) that it names, on 13 May 2027, both dates computed from the commencement notification, so treat them as interpretation until officially confirmed.
Plain English
Section 28 sets the Board's procedure. It functions as an independent body and, as far as practicable, as a digital office; it determines whether there are sufficient grounds to proceed with an inquiry, and if there are not it may close the proceedings for reasons recorded in writing; it conducts an inquiry following the principles of natural justice, with the powers of a civil court under the Code of Civil Procedure, 1908 in matters that include summoning and enforcing the attendance of any person and examining her on oath, and inspecting any data, book, document, register, books of account or any other document; and at any stage after receipt of a complaint, if it is of the opinion that the complaint is false or frivolous, it may issue a warning or impose costs on the complainant. Section 28 commences on 13 May 2027, a computed date, so treat it as interpretation until officially confirmed. Rules 19(9) and 20, both on procedure, are already in force: Rule 20 provides that the Board shall function as a digital office that, without prejudice to its power to summon and enforce the attendance of any person and examine her on oath, may adopt techno legal measures to conduct proceedings in a manner that does not require physical presence of any individual, and Rule 19(9) requires an inquiry to be completed within 6 months from the date of receipt of the intimation, complaint, reference or direction under section 27, unless the Board extends it, for reasons recorded in writing, by a further period not exceeding 3 months at a time. Section 27, to which Rule 19(9) refers, commences on 13 May 2027 under paragraph (c) of the commencement notification, except section 27(1)(d), which commences on 13 November 2026 under paragraph (b); both dates are computed, so treat them as interpretation until officially confirmed.
Plain English
Section 13(3) requires a Data Principal to exhaust the opportunity of redressing her grievance with the Data Fiduciary or Consent Manager under section 13 before approaching the Board. Where the Board is of the opinion that a complaint may be resolved by mediation it may direct the parties to attempt it (section 31); it may accept a voluntary undertaking at any stage of a proceeding under section 28, and acceptance bars proceedings under the Act as regards the contents of the undertaking, except where a term of it is not adhered to (section 32); and where it determines on conclusion of an inquiry that a breach by a person is significant it may, after giving that person an opportunity of being heard, impose a monetary penalty specified in the Schedule, having regard to the matters listed in section 33(2), with the sums credited to the Consolidated Fund of India (section 34). Any person aggrieved by its order or direction may appeal, in digital form under Rule 22, to the Appellate Tribunal, which section 2(a) defines as the Telecom Disputes Settlement and Appellate Tribunal, within 60 days from receipt of the order or direction (section 29(2)); the Tribunal may entertain an appeal after that period if satisfied there was sufficient cause for not filing it within that period (section 29(3)). Sections 13 and 28 to 34 commence on 13 May 2027 under paragraph (c) of the commencement notification, and Rule 22 on the same date under Rule 1(4); the date is computed, so treat it as interpretation until officially confirmed.
